International Contracts


One of the key practice areas of LALIVE IN QATAR LLP is international contracts, such as sales and distribution contracts, agency, franchise, license and concession agreements, construction and industrial engineering contracts, agreements, government contracts, Build-Operate-Transfer (BOT) projects and public procurement.

 

The firm provides advice and assistance in Qatar and elsewhere in the region to establish, develop, amend or manage complex contractual structures, including joint ventures, which require careful analysis, creative solutions and review of voluminous documentation. Services include advice on related questions such as taxation and anti-trust issues.

 

The firm also regularly deals with international commercial contracts subject to foreign law, in close cooperation with LALIVE and local attorneys. In addition to Swiss law, foreign law advice is available in particular for Austrian, Canadian, English, Finnish, French, German, New York, Spanish and Italian law matters.

The firm has particular expertise in international construction projects, advising clients, on a worldwide basis, in drafting and reviewing construction contracts, joint venture agreements, consortia agreements and turnkey contracts. Many of such contracts are based on industry models such as the International Federation of Consulting Engineers (FIDIC) and International Trade Centre (ITC). The team’s experience as counsel and arbitrator in international construction disputes provides added-value when drafting and reviewing contracts and when providing consultancy services in the management of construction projects, including risk assessment.

 

Lawyers of the firm have played an important role in the development of international law and practice in this area. Michael E. SCHNEIDER has acted as Chairman of the Drafting Team of the ITC (International Trade Centre) - Joint Venture Model Agreements, which are today widely used, together with Professor Jean-Paul VULLIETY (Rapporteur) from LALIVE. The firm’s lawyers are active in international specialised professional associations such as the International Bar Association (International Construction Projects Committee, formerly Committee T) and frequently publish in that area. They have for instance contributed to the leading commentary on FIDIC contracts.
